Patent and technical examination of a product or process

Comparison of technical solution features with the device, product or process examined.

When it is needed

In a dispute about use of a technical solution, preparation of a brief or checking an existing comparison.

What we examine

  • Patent and claims
  • Product, structure or technological process
  • Technical documentation and test results

Materials to prepare

  • Patent number and period to be checked
  • Product specimen or process materials
  • Drawings, diagrams and operating descriptions
  • Questions and information on how materials were obtained

Sample questions

  • Which features of the independent claim can be checked technically?
  • Which of the features examined are found in the submitted object?
  • Which features are absent or cannot be established from the available materials?
  • Are the drawing data consistent with the actual structure of the specimen examined?
  • Which additional data are needed to complete the comparison?

Build a set of questions →

How the work is carried out

  1. We identify the document version and object examined
  2. We build a table of technical features and supporting data
  3. We formulate conclusions for each feature checked

Result

A report with a feature-by-feature technical comparison and identification of circumstances not established.

What affects the conclusions

A device's overall appearance and name do not disclose all its features. Assessment of lawful use and infringement belongs to legal resolution of the dispute.

Frequently asked questions

Is a photograph of the product sufficient?

Only for features actually observable. Internal structure and operating parameters may require a specimen or technical documentation.

Can a technological process be examined?

Yes, if relevant documents and data about the actual implementation of its stages are available. Inspection arrangements are agreed separately.

How to link each feature to the specimen examined

A comparison must retain the object's identity: model, variant, configuration and available documentation version. A photograph of one product, a diagram of another modification and a description of a planned function do not automatically form a single examined specimen. Such differences should be identified before preparing the final table.

For each feature checked, it is useful to distinguish four items: the feature's content, the checking method, data actually obtained and the limits of the possible answer. For example, an external element may be observed during inspection, while an internal channel or operating sequence requires other relevant materials. Lack of an image of a concealed element is not equivalent to established absence of the element itself.

Materials for a focused comparison

  1. The full relevant patent document with claims, description and drawings.
  2. Identification of the product examined or description of the process actually implemented.
  3. Documentation relating to that particular variant, identifying its revision.
  4. Photographs, inspection or test results clearly linked to the feature checked.
  5. A list of disputed points in the earlier comparison, if it needs to be checked.

The final table must allow the reader to trace a conclusion to its supporting material. A general impression of product similarity and the same commercial purpose do not replace this comparison. If some features cannot be checked from the submitted set, they are identified separately and missing data explained. This maintains the distinction between established technical circumstances and legal conclusions in the dispute.
