Comparison of two abstract geometric packages

Reconstruct the exact objects examined

The check starts by identifying which signs the author actually compared. An image of the registered mark, the version on packaging and a written word in correspondence may differ. The reviewer checks document numbers and sources, element composition, colour presentation and material dates. If several variants of use were examined, a conclusion on one cannot be transferred to the others without explanation. This is first a matter of object identification.

The full report with appendices is important. They may contain the samples underlying the comparison, information on the goods considered and examination limitations. A cropped illustration may omit a caption or part of the composition. The reviewer therefore notes whether original material is available for checking and distinguishes a caption error from substitution of the object capable of changing the conclusion's substance.

Check the application of different criteria

For word signs, phonetic, graphic and semantic features are considered. A review checks the actual work, rather than merely the presence of three headings: which pronunciations are justified, how syllables and stress are compared, which written features are observed and where the proposed word meaning came from. If meaning depends on language or context, the researcher must explain the interpretation selected rather than present a single convenient guess as an established fact.

Graphic comparison requires consideration of a sign's composition, not only the shape of individual letters. For a combined mark, the interaction between word and image, changes when reduced and elements retained in the submitted version are important. The reviewer checks whether the author compared fragments stripped of inconvenient details instead of the original objects. Similarity at one level and difference at another must be discussed together, explaining their significance.

Clarify the role of individual elements

A word's large size does not fully explain its role in perception of the sign. The author should show why the selected element affects the overall impression and how other parts were considered. The reviewer looks for unjustified fragmentation of the composition, exclusion of differences and repeated counting of one correspondence under several headings. A list of common letters does not by itself explain the nature of similarity between the signs as a whole.

If a report discusses descriptive, common or unprotected elements, the grounds for that characterisation and its use in the reasoning are checked. A registration document and a dictionary meaning serve different purposes. A part of a sign occurring in the language cannot automatically be regarded as legally insignificant. Where necessary, the reviewer separates specialist examination of language and graphics from legal premises that require independent assessment in the dispute.

Trace the transition from comparison to conclusion

Observations on similarity must correspond to the question the author answered. If the conclusion concerns likelihood of confusion, it matters whether the relevant goods context is explained and what data support it. Matching class numbers alone do not substantively describe the goods. A review checks which information on purpose, selection conditions and consumers was actually examined, and which was merely asserted without analysis of relevant materials.

A perception survey, if included in the report, also requires independent checking. The audience, recruitment method, presentation of signs, question wording and response processing rules matter. The percentage choosing an option cannot be separated from those conditions. At the same time, absence of a survey does not itself prove every comparison wrong: a comment must explain which grounds are missing for the particular conclusion reached.

Formulate comments with verifiable consequences

A useful review links a report page, the observed problem and its effect on the answer. For example, it must show exactly which result depends on an unjustified reading of a word or a lost image element. If an explanation can resolve the shortcoming, state that explicitly. If checking requires another packaging specimen or a new dataset, text analysis is insufficient; a separate examination of that material is needed rather than stronger wording of an objection.

A reviewer may confirm some original observations while finding their combination insufficiently justified. Such a result need not establish the opposite degree of similarity. In litigation, the court assesses comparison of signs and decides infringement in light of the evidence. A review helps check the substance of specialist analysis, but does not predetermine the court's conclusion or make a methodological comment automatically end the dispute.
